In the United Nations Convention on the Law of the Sea no specific provision deals with military activities in the Exclusive economic zone (EEZ) of a third State. As a consequence, in order to establish their international legal regime, a qualification of each of these activities is required. Furthermore, because of the fact that the Coastal State enjoys jurisdiction concerning the protection of marine environment in its EEZ, it can exercise such jurisdiction also when marine pollution is caused by foreign ships engaged in military activities.

Abstract

In the United Nations Convention on the Law of the Sea no specific provision deals with military activities in the Exclusive economic zone (EEZ) of a third State. As a consequence, in order to establish their international legal regime, a qualification of each of these activities is required.
