The paper analyses the Court of Justice judgment of 22 January 2019 regarding the non-discrimination principle. Looking back at the Luxembourg case law on direct effect in horizontal disputes, the progressive emergence of the Nice Charter, now the main parameter of legitimacy in the Court’s decisions, is highlighted.
