La partecipazione al procedimento amministrativo nella recente legislazione Regionale Siciliana

The contribution examines the institution of participation in the procedure as described in the regional law. n. 7/2019. In particular, it is highlighted how the regional law reinforces participatory guarantees. The measures provided for in the regional law identify ex lege the person responsible for the procedure and force the administrations to adopt a new organizational structure. The number of recipients also needs to be expanded using a formula that includes all possible effects. Finally, the institution of the oral hearing is examined, an absolute novelty of the regulatory provision in question, of which elements of success and weaknesses are highlighted. Also taking into account the procedural consequences of the different attitude of the interested party's participation in the proceedings.
