Justinian’s religious politics is attributable to conscious recovery of so-called ‘political theology’, gained in the groove of Christian thought in the Fourth century, retrieval of eusebian suggestion of identification between unity of faith and ecumenical unity of the empire (as we read in the Nov. 6 of 535). The legislative powers always ascribed to the Emperor in religious matters give legal basis to defend orthodoxy: in this way, religion becomes a source of law in Justinian. As part of the complex relation between Church and Empire, the religious and doctrinal context of the antimonophysite council of Constantinople in 536 is analyzed from the historical and legal perspective, with particular attention to the text of Nov. 42, which gave legalistic sanction to the decisions of the synod.
