The essay analyzes the Italian act (law no. 69/2005) implementing the Framework Decision 2002/584/GAI, that has introduced the European Arrest Warrant. Both substantial and procedural aspects are examined, with particular attention on the consistency between the EAW and Italian Constitution. Moreover, the paper underlines the earliest problems raised by the Italian literature and case-law about the interpretation and the application of the national law.
