IL RUOLO DELLA GUIDA TURISTICA PER LA CONOSCENZA DEL TERRITORIO. PROFILI CIVILISTICI.

La visita della località e delle sue tipicità è parte integrante dell’esperienza del viaggio: la figura di un conoscitore del luoghi che sia anche un professionista del turismo appare centrale, per la sua posizione al crocevia di interessi pubblici e privati (la promozione del territorio e il trasferimento al visitatore della sua essenza culturale). La guida turistica appare così il medium ideale per comprendere il genius loci, inteso come lo spirito autentico del posto visitato. La complessa evoluzione legislativa sta tuttavia sensibilmente trasformando ed alterando la natura di questa figura centrale del turismo, i cui contorni non risultano ancora ben definiti. Owing to the complex legislative evolution, however, the nature of this central tourism figure is undergoing a marked transformation that leaves its outline nebulous as yet. This report sketches out a general picture of the changes in progress, also de iure condendo (about legislation to be established), focusing on the civil lawyer’s point of view relating to the nature of the activity and to the contractual aspects, with a mention to the tax provisions.
