Prendendo le mosse dall’evoluzione del rapporto tra omosessualità e legge penale, il presente saggio introdurrà il tema degli hate crimes ed, in particolar modo, degli hate speech, per soffermarsi in modo sintetico sull’impianto antidiscriminatorio attualmente presente nel nostro codice penale agli articoli 604 bis e ter Cp. Si approfondiranno, in primo luogo, i problemi penalistici da sempre legati all’incriminazione della parola pericolosa. Si cercherà poi di inquadrare il tema dell’hate speech omofobico alla luce della giurisprudenza di Strasburgo, onde vagliare criticamente alcune delle motivazioni addotte nel nostro ordinamento al fine di osteggiare l’introduzione di una normativa di contrasto all’omofobia. Ci si concentrerà infine sull’esame, articolo per articolo, del d.d.l. Zan nel tentativo ultimo di evidenziare come le perplessità sollevabili in tale settore non attengano realmente all’estensione del movente omofobico quanto, piuttosto, all’intera materia dei delitti contro l’eguaglianza. Starting from the evolution of the relationship between homosexuality and criminal law, this essay will introduce the theme of hate crimes and, in particular, hate speech, in order to focus briefly on the anti-discrimination framework currently present in our penal code in Articles 604 bis and ter Pc. In the first place, the criminal problems that have always been linked to the incrimination of the dangerous word will be explored. We will then try to frame the issue of homophobic hate speech in the light of the case law of Strasbourg, so as to critically examine some of the reasons given in our legal system in order to oppose the introduction of a legislation intended to fight against homophobia. Finally, the focus will be on the examination, article by article, of the Zan draft law in the final attempt to highlight how the concerns raised in this field do not really relate to the extension of the homophobic motive as, rather, to the whole matter of crimes against equality.
