This contribution first discusses the content and the scope of the freezing and confiscation measures respectively adopted and proposed by the European Union «in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine». Secondly, it questions whether these measures are compatible with the relevant international and European human rights obligations of the European Union and its Member States. The most problematic profiles concern the identification of the «leading businessperson» to whom the freezing measures can be applied and the proposed use of extend confiscation as well as other types of disguised non conviction-based confiscations.
