This essay deals with the multiple dimensions of the symbol in the juridical realm. The symbol is not only a tool that can be used for rhetorical purposes because of its capacity to grasp a universal concept within a representation, but it refers to a broad semantic field made of forms of expression and interpretive dimensions. It is understood as a function (and not just as a tool) and it depicts a relationship between law and language. Both the “absence” and the “surplus” characterizing the symbolic are necessary for the adaptation of legal terms to changing contexts.

Abstract

This essay deals with the multiple dimensions of the symbol in the juridical realm. The symbol is not only a tool that can be used for rhetorical purposes because of its capacity to grasp a universal concept within a representation, but it refers to a broad semantic field made of forms of expression and interpretive dimensions. It is understood as a function (and not just as a tool) and it depicts a relationship between law and language. Both the “absence” and the “surplus” characterizing the symbolic are necessary for the adaptation of legal terms to changing contexts.
