The essay is dedicated to the right to life in the Italian Constitution. The first part examines the debate within the Constituent Assembly and the decisions of the Constitutional Court on the right to life. The second part is dedicated to the way in which the right to life was conceived by the legislator. It is argued that the right to life is an implicit fundamental right, a prerequisite for the guarantee of all other rights. Coherently with the perspective assumed by the framers, the article underlines the importance of the connection (sometimes forgotten in the last decades) between the right to life and the protection of social rights.
