La libertà di insegnamento e i suoi limiti (profili di rilievo costituzionale)

Lo scritto tratta della libertà di insegnamento, con specifico riferimento ai suoi limiti. A questo fine, anche richiamando il pensiero di alcuni costituenti, si analizza il rapporto tra la libertà di insegnamento, la libertà di arte e scienza e la libertà di manifestazione del pensiero. Si tracciano, poi, talune considerazioni conclusive volte a mettere in luce in che misura l’insegnamento possa favorire un’istruzione conforme allo “spirito” della Costituzione, ponendosi quindi al servizio di quest’ultima e, in definitiva, della persona umana. The paper deals with freedom of teaching and it specifically focuses on the limits of such freedom. The essay, also recalling the thoughts of some Italian framers, analyses the relationship between freedom of teaching, freedom of art and science and freedom of speech. Some concluding considerations are then drawn in order to highlight that teaching could foster a model of education that could be in compliance with the ‘spirit’ of the Constitution. In this way, teaching could place itself at the service of the Constitution and, ultimately, of the human being.
